Terms of Service

Effective 15 October 2026 · Last updated 15 October 2026

1. Agreement

These terms govern your use of growthcouncil.net and your participation in The Growth Council, operated by [Legal entity name] ("the Council", "we", "us"). By using the site or attending a council dinner, you agree to these terms. If you do not agree, please do not use the site.

2. About the Council

The Growth Council is an independent council of marketing and growth leaders. We are not owned by or affiliated with any advertising network, agency or media platform. Council dinners are paid for by the Council and supported by a limited number of corporate sponsors, as described in section 6.

3. Seats and membership

  • Seats are offered by invitation at the Council's discretion. A request for a seat does not guarantee one.
  • We seat one leader per category to avoid direct competitors sharing a table. The Council decides categories.
  • Seats are personal and cannot be transferred, delegated or sold.
  • Information you give us when you request or hold a seat must be accurate.
  • We may suspend or withdraw a seat if a member breaches these terms or the confidentiality of the table.

4. The table and confidentiality

Council dinners run under the Chatham House rule. You may use what you learn at the table, but you may not reveal the identity or affiliation of the person who said it. You agree not to record, photograph or transcribe discussions, and not to share unpublished minutes outside the Council.

Do not share information at the table that you are not permitted to disclose, including your employer's material non-public information. You are responsible for what you share.

5. Conduct

We expect members, guests and sponsors to treat one another with respect. Selling, soliciting or pitching at the table is not permitted. Harassment or discrimination of any kind leads to removal from the Council.

6. Sponsors

Sponsors support council dinners. A sponsorship is governed by a separate written agreement between the sponsor and the Council. Sponsors do not buy seats, set the agenda, or edit the minutes, and sponsor representatives at the table follow these terms like every other participant.

7. Content and minutes

The site, the Council's name and seal, and published minutes belong to the Council and are protected by intellectual property law. You may share links to and short quotations from published minutes with attribution to The Growth Council. Any other reproduction requires our written permission.

When you contribute to a discussion, you allow the Council to report its substance in minutes without identifying you, under section 4.

8. Using the site

Do not misuse the site: no interfering with its operation, attempting unauthorized access, scraping it at scale, or sending unlawful or misleading content through the contact form.

9. No professional advice

Discussions and minutes reflect the experience and opinions of participants. They are not legal, financial, investment or other professional advice. Decisions you make based on them are your own.

10. Links to other sites

The site may link to sites we do not control. We are not responsible for their content or practices.

11. Disclaimers

The site and the Council's services are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. Dinner dates, venues and agendas may change.

12. Limitation of liability

To the fullest extent the law allows, the Council is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the site or the Council is limited to the greater of the fees you paid us in the 12 months before the claim and US$100. Nothing in these terms limits liability that cannot be limited by law.

13. Indemnity

You agree to indemnify the Council against claims arising from your breach of these terms or your misuse of the site, including breaches of confidentiality.

14. Governing law

These terms are governed by the laws of [State of New York], without regard to its conflict-of-law rules. Disputes will be resolved in the courts located in [New York County, New York].

15. Changes and termination

We may update these terms. When we do, we change the date at the top and notify members of material changes by email. Continuing to use the site or hold a seat after an update means you accept it. We may suspend access to the site at any time.
